Professional Services Terms

How Tideway-managed permitting engagements work.

These Professional Services Terms apply when you engage Tideway Permitting to manage a marine permitting project. Each engagement is also governed by a project-specific scope of work (“SOW”) that you approve before work begins.

Scope of work

Every engagement begins with a written SOW describing the services, deliverables, estimated costs, and payment milestones. Work begins only after you approve the SOW. If your project needs change, we will document the change before performing the additional work (see Change Orders).

Licensed technical services

Tideway coordinates and manages the permitting process. Licensed technical services — including surveying, engineering, and environmental consulting — are performed by appropriately licensed professionals and subcontractors. Those professionals are responsible for their own licensed work product; Tideway is responsible for procurement, scheduling, coordination, quality control, and accountability.

How fees work

Survey, engineering, and environmental services are competitively procured under clearly defined scopes and billed on a transparent cost-plus basis. Tideway’s managed-service premium covers professional procurement, scheduling, coordination, quality control, and accountability. Government fees are billed separately at actual cost. All scope, estimated costs, and payment milestones are approved before work begins.

What we control — and what we do not

We control the preparation, coordination, and responsiveness of your permit package. We cannot control agency timelines or approval decisions. Nothing in these terms or any SOW is a guarantee that a permit will be issued or issued within a particular timeframe.

Your responsibilities

  • Provide accurate project information and any documents reasonably needed to prepare the package.
  • Confirm authorization for the property and, where applicable, the homeowner relationship.
  • Review and approve scopes, estimates, and milestones in a timely manner.

Change orders

If agency requirements, site conditions, or your instructions require work beyond the approved SOW, Tideway will prepare a written change order describing the additional scope and estimated cost. Additional work proceeds only after the change order is approved.
